Arthipo’nun yurt dışı (uluslararası) satış modeline, küresel e-ticaret standartlarına (AB Tüketici Hakları Direktifi dahil) ve sınır ötesi kargo/gümrük dinamiklerine uygun olarak hazırlanan yeni sözleşme metni aşağıdadır.
Yurt dışı gönderimlerinde gümrük vergileri (Customs Duties/Taxes) ve uluslararası kargo maliyetleri çok kritik olduğundan, metne bu yasal korumalar da eklenmiştir.
ARTHİPO INTERNATIONAL CANCELLATION AND RETURN POLICY
1. GENERAL PROVISIONS & APPLICABLE LAW
1.1. This agreement governs the cancellation and return procedures for international orders placed on Arthipo. By completing a purchase, the Buyer agrees to these terms.
1.2. For international sales, return and cancellation processes are managed in accordance with international e-commerce regulations, including the EU Consumer Rights Directive where applicable, subject to the exceptions listed below.
2. RIGHT OF WITHDRAWAL (REFUNDS)
2.1. For eligible products, the Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery without giving any reason.
2.2. To exercise the right of withdrawal, the Buyer must notify Arthipo in writing via email or the customer support panel within this 14-day period.
3. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL (NON-REFUNDABLE PRODUCTS)
Pursuant to international consumer laws regarding custom-made and digital goods, the Buyer cannot exercise a right of withdrawal for the following categories:
3.1. Custom-Made / Printed-on-Demand Products: Custom-sized canvas prints, oil painting reproductions, and products with custom frame selections are manufactured individually based on the Buyer's explicit requests and personal choices. Therefore, unless the product is defective or damaged, no returns or key-in/change of mind refunds are accepted.
3.2. Digital Contents: Digital image downloads, high-resolution digital files, or any intangible goods delivered instantly in an electronic environment cannot be cancelled or refunded once the download link is generated or delivered.
3.3. Original Artworks: Original, one-of-a-kind paintings can be returned within 14 days, provided they are returned in their original condition, with their certificate of authenticity, and without any damage or alteration.
4. CANCELLATION BEFORE SHIPMENT
4.1. The Buyer may cancel an order completely before the production phase begins or before the package is handed over to the international courier (DHL, FedEx, UPS, etc.).
4.2. Once the cancellation is approved, the total amount will be refunded to the Buyer’s original payment method (Credit Card, PayPal, Stripe, etc.) within 14 (fourteen) business days.
5. DAMAGED ITEMS AND INTERNATIONAL SHIPPING CLAIMS
5.1. The Buyer is obliged to inspect the package upon delivery by the local courier. If any visible damage (tears, breaks, punctures) is detected on the packaging or the artwork, the Buyer must report it to the courier courier immediately and file a "Damage Report / Claim" before accepting the package.
5.2. Arthipo must be notified of any damaged items within 48 hours of delivery, accompanied by photos of the damaged box and product. For verified shipping damages, Arthipo will arrange a replacement or issue a full refund, and cover the return shipping costs if a return is requested.
6. RETURN SHIPPING, CUSTOMS DUTIES, AND REFUND PROCEDURE
6.1. Return Shipping Costs: For returns based on a change of mind (where applicable, e.g., original artworks), the Buyer is responsible for all international return shipping fees, packaging costs, and insurance.
6.2. Customs Duties & Taxes: Any customs duties, import taxes, or clearance fees paid by the Buyer during the initial import are non-refundable by Arthipo, as these are collected by the Buyer's local government. Additionally, any customs duties incurred by Arthipo during the return process will be deducted from the Buyer's final refund total.
6.2. Processing Time: Once the returned item is received at the designated warehouse, inspected, and approved, the refund will be processed within 14 business days. The time it takes for the funds to appear on the Buyer's statement depends entirely on the financial institution or payment provider.
7. INTERNATIONAL RETURN LOGISTICS
Important Note for International Returns: Before shipping any item back, the Buyer must contact Arthipo Support to receive the correct international return address and custom invoice documentation. Returns sent without prior notice or a tracking number will not be accepted.
